From Opioid addiction to the medical and recreational use of marijuana, employers are faced with many challenges, and questions about conducting substance testing for applicants and employees. Employers are often left wondering who, when, and how they may or may not conduct testing. On top of that, employers have to deal with non-substance testing medical exams such as, fitness for duty, return to work, and others that may have implications under the ADA. Also, we can't leave out the non-medical exams such as skills assessments, leadership inventories, and the whole array of selection procedures that are regulated by the (UGESP) Federal Uniform Guidelines on Employee Selection Procedures.

Over the last several years, the National Labor Relations Board has issued at least three new guidances on employer’s Social Media policies illustrating when, and why they do or do not violate the National Labor Relations Act (NLRA). In June 2016, the US EEOC published guidance on employers practices calling for them to “reboot” any current practices related to workplace harassment prevention and correction. Two months later in August, the commission published guidance on workplace retaliation. The agency also recently filed its first lawsuits alleging unlawful harassment based on sexual orientation.
