Kleen Products Case Claim Procedures Now Available

In November of 2010, several buyers of finished corrugated boxes filed a class action lawsuit against several major containerboard producers alleging collusion and price fixing for the price of containerboard between 2004 and 2010. This case is generically known as “The Kleen Products Case.” The companies named in the complaint were: Norampac (now Cascades); International Paper (Weyerhaeuser; Temple-Inland); Packaging Corporation of America; Georgia Pacific and RockTenn (Smurfit-Stone Container Corp.).
Norampac, PCA and International Paper have all reached settlement agreements totaling $376 million. On August 3 of this year the court granted summary judgment in favor of the remaining defendants WestRock and Georgia-Pacific, which decision is currently on appeal in the Seventh Circuit.
The Kleen Products Case is a class-action lawsuit. If you purchased “Containerboard Products,” defined by the Court as linerboard, corrugated [sic] medium, corrugated sheets or finished corrugated products from the named defendants between February 15, 2004, and November 8, 2010, you are automatically considered to be part of the “class” of plaintiffs unless you previously opted out.
The purpose of this letter is to let you know that claim forms are now available for all members of the class. There are two versions of the claim forms, both of which were approved by the court on October 17, 2017. You may have received a pre-populated claim form, and if so, you may use that form. Or, you may use the general claim form which is attached to this email. The settlement funds are being administered by a court-appointed Settlement Administrator, A.B. Data, Ltd., P.O. The deadline for claim forms is February 6, 2018.
Whether you take advantage of this settlement is your decision based on consultation with your own legal counsel. You may have received notices or solicitations from attorneys seeking to represent you in this litigation. They are usually claiming to file for you on your behalf. You may certainly engage these firms if you wish, but please understand that using the services of an outside attorney to file a claim is not necessary. The court, in approving the claim forms, noted that they are “relatively simple” to complete. Individuals or companies may do this on their own.
