The Department of Labor has sent a proposed rule that would change the criteria for exemptions to federal overtime pay requirements to the White House Office of Information and Regulatory Affairs (OIRA) for review. This is a required initial step in the regulatory process. See official government announcement below my signature line and here.
AICC partner PPWO says, “We do not know the substance of the proposed changes or how long OIRA will take reviewing the regulation, but we do think commencing OIRA review now increases the chances that DOL will release the proposed rule at or close to the August 2023 target date set forth in the Spring 2023 regulatory agenda.
OIRA review creates an opportunity of advocacy. OIRA takes meetings to hear from concerned parties about proposed rules under their review. PPWO leaders will be requesting meetings individually and jointly to reiterate concerns we set forth in our May 25, 2023 letter requesting DOL delay or abandon the rule. The OIRA meetings are virtual and we encourage others to request a meeting through theOIRA portal to discuss their concerns.
